The reclassification of a civil lease as a main-residence lease is the main legal risk of medium-term rental in Paris. It retroactively brings the contract under the 1989 law: rent control, minimum term, right to remain in the premises. Here are the seven mistakes that trigger it — and how to avoid them.
What reclassification means
A judge is not bound by the title of a contract. They look at the reality of the occupancy. If the home is in fact the tenant's main residence, the law of 6 July 1989 applies automatically, whatever the lease says. The consequences are serious: repayment of overpaid rent if the rent-control cap was exceeded, reclassification of the lease term, the right to remain in the premises and regulated notice.
Mistake 1 — Not checking the tenant's main residence
This is the fundamental mistake. Before signing, require proof of a home elsewhere: a rent receipt, a property or council tax notice, an accommodation certificate. Without this document, the arrangement rests on a mere declaration.
Mistake 2 — A lease that is ambiguous about its purpose
A contract that provides for two scenarios without choosing — "as a main residence" or "where the home is not the main residence" — has already been reclassified by the Paris judicial court. The lease must clearly designate one regime, and one only.
Mistake 3 — Chaining short stays
In three rulings dated 24 February 2026, the Paris judicial court held that short civil leases, chained with transient tenants, were in reality furnished tourist lettings — which in Paris require a change of use and registration. A civil lease does not turn a short-term activity into a medium-term one.
Mistake 4 — Extending indefinitely
A tenant who stays for twelve, eighteen or twenty-four months ends up making the home their main residence, whatever the clauses say. The longer the occupancy, the more the body of evidence turns against the landlord.
Mistake 5 — Ignoring a change in circumstances
Case law accepts reclassification during the lease: a tenant who loses their other home — sale, separation, end of a lease elsewhere — can argue that the rented property has de facto become their main residence. Regular checks are essential.
Mistake 6 — Not keeping the file
The documents gathered before signing are only worth anything if they are kept. In a dispute, it is up to the landlord to prove that the arrangement is consistent. Keep the lease, the documents and the correspondence for several years after the occupancy ends.
Mistake 7 — Building the strategy around the rent
Choosing the civil lease because it escapes the rent-control cap, rather than because the tenant's situation justifies it, reverses the legal logic. That is exactly the reasoning the courts penalise.
The five-point method
- Qualify the applicant before qualifying the contract.
- Document the main residence elsewhere and the reason for the stay.
- Draft unambiguously the purpose of the letting.
- Limit the term and avoid endless renewals.
- Have the template reviewed by a lawyer, and update it whenever case law changes.
