The rent supplement makes it possible to exceed the rent-control cap in Paris legally. It is also the most disputed clause in Paris leases: if poorly justified, it exposes the landlord to repaying the overpaid rent. Here are the criteria that are actually accepted, those that are systematically rejected, and the method to secure yours.
The mechanism in two minutes
In Paris, the base rent of a letting governed by the 1989 law cannot exceed the increased reference rent — the median rent for the area, the type of home and the construction period, plus 20%. The rent supplement is the only exception: it is added to the base rent when the home has exceptional features, in terms of comfort or location, compared with similar homes in the same area.
The rent supplement is not a market adjustment. It is an exception that must be justified property by property, feature by feature.
Features generally accepted
- A private terrace or garden of a significant size.
- A remarkable heritage view with an open outlook.
- An exceptional ceiling height, beyond the standards of the area.
- Rare features: vaulted cellar, working fireplace, swimming pool, sauna.
- An unusual volume or layout with no equivalent among comparable homes.
Justifications regularly rejected
- A high-quality renovation: fine materials and modern decor are an expected standard, not an exceptional feature.
- New equipment: dishwasher, recent appliances, television.
- The neighbourhood: it is already factored into the area's reference rent.
- A lift, a caretaker, double glazing: common in Paris housing.
- Being furnished: the furnished rent grids are already 10 to 15% higher than unfurnished ones.
Formal requirements
A rent supplement is only enforceable if it is expressly stated in the lease, separate from the base rent, and justified by precisely described features. The lease must also state the applicable reference rent and increased reference rent. Leaving these out weakens the whole contract.
The risk of a poorly justified supplement
The tenant has a set period to challenge it before the departmental conciliation commission, and then, if necessary, before a judge. If the challenge succeeds, the supplement is removed and the overpaid rent is refunded, sometimes over several years of the lease. On top of this comes a real reputational risk for a landlord who lets regularly.
The four-step method
- Check the exact cap for the property on the official DRIHL Île-de-France simulator (address, type, construction period, furnished or unfurnished).
- List the features that are genuinely out of the ordinary, and rule out anything standard.
- Document: dated photos, measurements, floor plans, terrace size, ceiling height.
- Draft the clause by describing the features relied on, not by invoking the market.
An issue that goes beyond November 2026
On 21 October 2026, the Senate voted to extend rent control until 24 November 2028, a vote the National Assembly must still confirm. The text also extends from three months to one year the period a tenant has to challenge a rent supplement. Whatever the outcome, leases signed during the rent-controlled period remain subject to the rules in force on the day they were signed: an unjustified rent supplement agreed today will still be open to challenge tomorrow.
